USA CLUB MEMBERSHIP TERMS & CONDITIONS

TERMS & CONDITIONS OF SALE INCORPORATED:
All standard “Terms & Conditions of Sale” pursuant to any service agreement with ILM Properties, LLC, dba Smith Plumbing & Heating (hereinafter “Smith Plumbing”) are incorporated herein and apply in tandem with Customer’s USA Club Membership.

RESULTS OF EARLY TERMINATION/BREACH:

Whether Customer chooses the USA Bronze (1 year), the USA Silver (2 year) or the USA Gold (3 year) USA Club Membership, customer is entitled to all discounts as detailed in the relevant tier offering. If Customer terminates or breaches Customer’s underlying service agreement with Smith Plumbing, cancels his or her USA Club Membership prior to the agreement’s specified termination date, or otherwise fails to remit any amounts due and owing to Smith plumbing for a period exceeding Thirty (30) days, then all discounts received under any tier of Smith Plumbing’s USA Club Membership program become null and void and said amounts associated with any received discount/s become immediately due and owing to Smith Plumbing in arrears.

This USA Club Membership, in addition to any and all warranties, with the possible exception of manufacturer warranties, whether express or implied, shall not apply and shall become null and void in the event Customer later engages self-repair or enlists a third-party contractor or contractors for replacement, repairs, maintenance or service.

PROMOTION STACKING EXCLUDED:

Supplemental Smith Plumbing discounts, promotions or offerings cannot be added to or “stacked” upon USA Club Membership discounts. All discounts are applied to the current list price of the goods or services provided and cannot be combined with any other offer. However, if Customer wishes to apply any alternative supplemental Smith Plumbing promotion in lieu of that offering’s comparable USA Club Membership discount, Customer may opt to do so.
